I. Voting
rights for Indian Nationals
ø The
Representation of People (Amendment) Act 2010 which seeks to amend the
Representation of People Act, 1950 was enacted on 22nd September, 2010.
ø Thereafter
the Registration of Elector Rules, 1960 were amended by the Registration of
Electors (Amendment) Rules, 2011 on 3rd February, 9th February and 23rd
February, 2011 to give voting rights to overseas Indian electors.
ø All
applicants may send their self-attested documents to the concerned Electoral
Registration Officers.
ø The
identification of overseas electors at the time of casting their votes at the
polling stations shall be done on the basis of their original passports.
ø The
overseas electors have to fill a Form 6A for registering themselves for voting
in India. Form 6A is available on the website of the Election Commission
of India (eci.nic.in).
ø Form
6A may be sent by post to the concerned Electoral Registration Officers (EROs)
of the concerned constituency in which they are to be registered as voters, or
deposited with EROs in person.
ø The
ERO will be the one which corresponds to the Indian address as mentioned in the
passport of the overseas electors.
ø The
details and particulars of EROs are available on the website of the Election
Commission of India (eci.nic.in).
ø The
documents required are the relevant pages of the passport containing name, date
of birth, place of birth, father’s name, place of residence in India, passport
details and details of the visa.
ø After
enrolment, overseas electors will be able to cast their vote in elections in
their constituency, if they are physically present in the polling station along
with their original passport on the day of the poll.
II.
Registration of Indian Nationals :- (For those Indian Nationals who are
resident in Nepal)
1. Two
recent passport sized photographs
2. Any
one of the following documents as proof of Indian Nationality
· Passport
· Voter
Card
· Domicile/Residential
Certificate (with photograph)
· Caste
Certificate. (with photograph)
3. Proof
of Occupation/Residence in Nepal.
Occupation : Certificate in company letterhead stating that the
individual has been working in the firm and should also mention the period of
employment.
Residence : Certificate from the owner signed with undertaking
that, the Indian National has been living in his/her house. Also a photocopy of
owner’s citizenship certificate or other document regarding ownership of
property will be required along with water/electricity bill in the name of house
owner.
4. Fees:
No charge for first time.
III. DUPLICATE
REGISTRATION (IN LIEU OF LOST/DAMAGED REGISTRATION)
1. Two
recent passport sized photographs.
2. *Details
of earlier registration.
3. To
submit FIR lodged at the local police station
* The applicant is required to furnish details of the earlier Registration
certificate as far as possible. If he does not know, the earlier Registration
number, he will be issued a new certificate with new number, after paying the
fees as admissible, for a new certificate.
4. Current
documents as indicated in PART II above (Registration of Indian Nationals)
5. Fees
: NRs 2590/-
IV. BIRTH
REGISTRATION :
Applicants are
required to fill online form through the www.indiancitizenshiponline
under section 4 (1), take a print out of the form, upload necessary documents
and visit Embassy along with printed copy of form, requisite documents and
photographs to the Embassy and pay fee of NR. 2590/-.
Appointment can be
booked for submission of application and fee at the Embassy through indembkathmandu.gov.in.
Applicants can visit Embassy on the date of appointment.
V. DEATH REGISTRATION
1) Proof of deceased being an Indian National.
2) Papers issued by the hospital authorities, if the person has died in the
hospital. If, the death is unnatural, the paper issued by the local police
authorities is mandatory.
3) Papers related to cremation (if cremation has taken place in Nepal).
4) Fees: Nil
VI. MARRIAGE
REGISTRATION
1) Two recent passport sized photographs.
2) Copy of notice to be published in the National Daily, one in Nepal and one
in India (the place of domicile of the applicant) stating that notice has been
given for registration of marriage at the Embassy.
3) Proof of nationality of bride and groom. One of them should be an Indian
national.
4) Three witnesses (one Nepali & two Indian or vice versa).
They have to submit papers pertaining to their nationalities and have to come
in person to sign the witness papers.
5) Photograph of their marriage and invitation card of marriage.
6) The marriage is registered only after one month from date of publication of
notice in the newspapers.

MARRIAGE REGISTRATION WILL BE CONSIDERED ONLY FOR MARRIAGES PERFORMED IN NEPAL.
VII.
ATTESTATION
1) One
recent passport sized photograph.
2) Recommendation Letter issued by Ministry of Foreign Affairs, Nepal for
Nepalese Nationals.
3) If attestation is for the Indian National, we require proof of Indian
nationality.
4) If the document is issued by Nepali institution, it should be endorsed by
the concerned ministry.
5) Fees: ON EACH FACE OF THE DOCUMENT.
I. Documents

NOTE
: Indian documents for attestation (Marriage/Death/Birth, Education
degrees, Documents issued by Indian Courts etc.) must be authenticated
/attested by MEA, Patiala house, New Delhi.
II. Attestation
of Trade/Commercial documents or issue of any certificate pertaining to export
from India to a foreign country and Attestation of Trade/Commercial documents
or issue of any certificate pertaining to export from foreign countries to
India.
